Why CAA, NPR & NRC are Harmful? How it is unconstitutional?

Why People around the country are protesting and demanding the Government to take this Act back.

Is this Act is against the Constitution? Yes, it is unconstitutional. You will find it how and in what manner it is unconstitutional?

Well before that, there are few questions which are being phrased?

1.   How CAA is unconstitutional?

2.   If this Act only means giving Citizenship to someone then why people are protesting to withdraw this Act?

3.   What’s the purpose of this Act and how it is affected?

4.   Has Congress Party Proposed this Act Back in 2003? Then why congress is opposing this Act Now?

5.   How is it more dangerous when it Links with NRC?

Eventually, these question themselves have answers to Justify.  Let’s look each and every one of them individually?

Why this Act is unconstitutional?

CAA is Discrimination and anything which is Discrimination is unconstitutional.
If This Act only means giving citizenship to someone who is facing religious persecution even then it stands un-constitutional. Because—

This Act allows Discrimination and anything which is Discriminated will be declared as unconstitutional.

How is this Discriminated?

This Act violates the Article 14^th rule of the constitution, which Justify

“Right to Equality” irrespective of Caste, Religion, Sex & Color

Briefly, Discussed of Being Discrimination?

1. CAA allows only Non-Muslim People to avail Citizenship, whereas the Indian Constitution Preface starts with: “We, The People of India”.., which means only people and it doesn’t describe any specific religion, caste, Color, and Sex. It gives equal rights to each and every individual irrespective of religion and caste.

2. If people are facing persecution based on religion then why did Govt only choose Pakistan, Bangladesh, and Afghanistan? Why not the entire world, if talking about Human Rights?

There are many Islamic countries in the world? Where Hindus, Sikh, Christian, Isai are Minorities, Even they are facing persecution on a religious basis? Why they are not eligible to avail Citizenship?

Why chosen neighboring countries only?

Govt is claiming that people from these countries are separated during Independence. They belong to us. Their origin is Indian. There are many Hindu, Sikh, Isai and other community people who left during independence are being persecuted on a religious basis and hence we will help them through this Act.

Now when did Afghanistan separated from India, It was only Pakistan(East Pakistan) and Bangladesh(West Pakistan) were Separated during Independence, then why the Govt  getting people from Afghanistan. Since People from that country are not Indian Origin

Now Afghanistan Never ever was the part of India and Never Separated from India. Afghanistan is a totally different country. Afghanistan has nothing to do with Indian Independence.

Hindu Rashtra?

It seems like this move is showing a lot of interest and heading towards making of Hindu Rashtra, collecting Hindu narratives from across the nation and trying to make it as Hindu Rashtra.

India is a collective of many religions, a lot of emotions attached to each religion. Each one of us respects the culture of other religion, we are bond together and we will never get divided by hatred like you.

Has Congress Initiated this Act back in 2003? If yes, then why now they are against this Act?

CAA was initiated by congress party and this act means people who left in Pakistan & Bangladesh during Independence will get the right to come back to India if they wish, irrespective of any religion he/she maybe? But now this Act is framed and Limited to certain religions and conditions – which is unconstitutional. Hence Congress Party and other Regional Parties including Aam Aadmi Party are opposing this Act.

This Act is totally focused on Specific religion which is unconstitutional and violates the Article 14^th rule of the Constitution which justifies the Right to Equality.

Moreover, Afghanistan is not included in this Act by the INC Party when they initiated back in 2003 because Afghanistan is not even the part of the India earlier independence nor during the Independence. Then why people are brought up from Afghanistan saying that they were left during independence.

If Govt bringing people who are facing religious persecution then why did they only choose 3 countries, there are many Islamic states where Hindu is being in minority and facing religious persecution but they are not allowed to avail citizenship, and if they are initially looking for a specific country based on separation from India and people left who there and wanted to come to India but couldn’t come due to any reasons, then they are most welcome., but why Afghanistan? Afghanistan was never separated from India.

Are you really looking after People from Neighboring Countries? Or

Are you really looking after people who belong to Non-Muslim Community?

If you think some people wanted to come to India and they couldn’t come because of the personal & family reasons during independence and now if they want to come to India then No Problem whatsoever, they can come irrespective of any religion?

India always ready to welcome them? But what about People who are coming from Afghanistan? They were not left during independence?

Aren’t you calling people from across the borders based on religious terms and trying to divide the nation especially in Hindu - Muslim Community?

What happens if CAA links with NRC?

National Register of Citizens (NRC) is something which implies throughout India, when NRC is in action every Indian should prove his/her Nationality based on valid documents.

Documents which are Not Valid are Aadhar, Pan Card, VoterID, Ration Card, Passport, Driving License and many other Govt Identification Proofs that initiated and fall under Central Govt. Then what Govt is seeking from its citizens, what proof they need to prove citizenship.

Documents Valid:

Any Documents which highlights the property proof bought or sold back in the 1990’s and any documents which are showcasing that there ancestors were Indians and their origin is real Indian, will be proved as Indians

Documents which Prove your ancestors were Indians

Show documents of property from the 1990s (Bought or Sold)

Prove you are Indian by showcasing you or your ancestor’s contribution to the country in terms of being in any Govt Department, Part of Military, Part of State Service, or anything that is in under the Central Govt terms and Policies, then you are through NRC.

What about people who are Document less:

Those who found Document less and could not able to prove Citizenship; those will be declared as illegal immigrants and will be further taken to Detention Camps by taking all the legal Citizenship Rights from them. Now they are no more Indian Citizens and have no right to fight for? They will be declared officially as illegal immigrants.

Those illegal immigrants taken to Detention Camps & will be checked of what religion they belong too, if they are Hindu then they can avail the citizenship again through CAA, but lose all the property they had, and they made all these years, but if they are Muslim then they are completely declared as illegal immigrants and filled in Detention Camps forever.

Contradiction and Disputes:

Now where it started all, despite so many protest Govt seems to stay by its decision not to take CAA back.

There are double statements & Standards by the Prime Minister and the Home Minister considering CAA and NRC which left people in a dilemma whom to trust. Home Minister made it very clear that there will be NRC soon throughout India, whereas Prime Minister Quotes: There are no such Dialogues made yet with regards to NRC. Now it’s difficult to trust which is fair enough.

People across the country understood this so soon that Govt has nothing left to adjust with their own decisions but to twist their own words every now and then. With this, it’s crystal and clear that NRC is going to come sooner or later.

Now the big question is:

People who voted them to form a Govt & given a chance to serve the nation, same Govt asking them to prove their citizenship. Who are they to ask?

If you are calling all the Hindus from across the world then you are against Constitution? History always recalls whenever there is an act made against Constitution or anything which violates the Indian Constitution - People of India stood tall and fought against its own Govt and Troops - doesn’t matter how many lives it will cost.

India is a democratic country, and everyone here has equal right and has no space for discrimination based on religion, caste, Gender…

Who can apply for Indian Citizenship through CAA Act?

People who are facing persecution can apply for Indian Citizenship through this CAA-Act. But it is only restricted to countries like Pakistan Bangladesh and Afghanistan, that too person who is from Non-Muslim Community.

This violates the rule of Article 14^th of the constitution which Justifies the Equality Irrespective of any religion, Caste, Gender and Color.

Purpose of this CAA ACT?

Purpose of this Act is to bring the Non-Muslim people from across the border in the name of persecution based on religion to ultimately make this as Hindu Rashtra
